Information about these Terms & Conditions
learningresourcehub.co.uk is owned and operated by North Wales Nail and Beauty Ltd. (“We, Our, Us”) We are a company registered in England and Wales under company number 09903989 and with our registered office at 24 Brookes Street, Llandudno, LL30 2TT.
Where these terms and conditions use terms such as "you" and "your" they refer to you the purchaser.
Learning Resource Hub is a trading name of North Wales Nail and Beauty Ltd. Learning Resource Hub offers educational resources and business services (“services”) via remote delivery in the form of platform hosting and the sale of digital material including training manuals and digital resources via this website.
Our terms and conditions cover the terms applicable for use of this website. By visiting our website, you accept and comply with our terms and conditions. Should you not agree to our terms and conditions, please cease engagement with our website.
Jurisdiction
These Terms are governed by the laws of England & Wales. The Courts of England & Wales have exclusive jurisdiction over any matter and proceedings arising out of your purchase.
Entire Agreement
These terms and conditions combined with our published Privacy Policy (also available through this website), and Fair Use Policy (also available through this website), constitute the entire agreement between the parties and supersede all preceding and contemporaneous agreements between you and us whether written or oral.
1.0 General
Learning Resource Hub reserve the right to the design, text and graphics of all course material, handouts, website material and published literature under The Copyright, Designs and Patents Act 1988. The use of any material for the purposes of reproduction including alteration, modification and redistribution is strictly prohibited.
Learning Resource Hub takes no responsibility for the content of any external hyperlinks or website information given to learners. It is your responsibility to exercise due diligence.
Our email support is manned Monday to Friday between 8am to 5pm. We will respond as soon as possible and within 48 hours during the hours stated.
We intend to rely on the written terms set out in these terms and conditions in respect of the resource digital downloads delivered to you. These written terms shall constitute the entire agreement between us.
If any provision or part-provision of these terms and conditions is or becomes invalid, illegal, or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any such modification or deletion shall not affect the validity and enforceability of the rest of these terms and conditions.
1.2 Website Information
We endeavour to ensure our website content is accurate. However, we accept no responsibility for incorrect content that may exist.
No liability is accepted for any loss, direct, indirect, or consequential, that may arise from information gained from our website in respect to any website error or omission.
1.3 Pricing
All prices on our website are displayed in Great British Pound (GBP).
Prices listed on our website are subject to change at any time without prior notice. Price is agreed upon receipt of your order.
All payments are made via secure connection and cannot be viewed by anyone else. We do not store your card details. All card details are handled and processed by ‘Stripe’ or ‘Klarna’ who are fully PCI compliant. Should refunds be issued they will be processed using the same details as the original payment method.
We reserve the right to cancel any orders at any time without explanation or compensation to you.
2.0 Resource Digital Downloads
Resource Digital Downloads are identified as: training manuals, schemes of work, teaching guides, printable resources and other associated material and will be referred to as “Resource Digital Downloads”. Resource Digital Downloads are solely digital products, downloadable upon purchase. There is no physical item for this type of purchase. Due to the nature of these products, there are no refunds or exchanges. All sales are final.
Failed or Lost downloads can be repurchased at a charge of £30 per download, plus £5 for each additional download per request. Repurchasing is only valid within 3 months from the date of the initial purchase and will only be provided to the original purchasing email address.
Learning Resource Hub accepts no responsibility for the suitability of the resource digital downloads to you. It is your responsibility to ensure you have the correct hardware/software to access and use your purchase and that the resource is suitable for its intended purpose.
Should you consider that the digital download is faulty for any reason then please contact us within 24 hours of purchase. It is your responsibility to check access to digital downloads within 24 hours of purchase. Should you have any concerns or questions please contact us on contact@learningresourcehub.co.uk.
2.1 Intellectual Property of Digital Downloads
You will be provided with resource digital downloads. At all times, even following purchase, the intellectual property rights and copyright connected with those materials remain us. You have the right to add your branding to the materials for distribution as part of an education programme within your own academy. You are not permitted to imitate, loan, or provide copies to third parties whether for free or as part of a business to business sale. All documents are digitally marked and can be traced back to us.
2.2 Feedback and Complaints
If you have any feedback about our resource digital downloads, please do share it with us. It is always great to receive words of praise and helpful to get constructive comments. We really hope that you love our resource digital downloads but if you would like to make a complaint this should be made to made in writing to contact@learningresourcehub.co.uk.
2.3 Updates, Changes and Content
Our resource digital downloads are subject to removal from sale, updates, and modifications at any time. No responsibility is accepted by us for changes made to our material in relation to your purchase.
We endeavour to ensure the information provided to you in our resource digital downloads are correct, however it is your responsibility to check the content and use the resource digital downloads responsibly.
2.4 Accreditation
Our resource digital downloads are designed to be used to gain accreditation through accreditation bodies for the purpose of teaching accredited training courses. We accept no responsibility in the guarantee that accreditation will be achieved. It is your responsibility to ensure you have the correct and sufficient material to meet the criteria of your chosen accreditor. If you are unsure, please check with your chosen accreditor prior to purchase.
2.5 Qualification
Purchasing resource digital download does not constitute qualification in the purchased subject area. No responsibility is taken by us for training or treatments carried out without the relevant qualifications in place. It is your responsibility to ensure you hold sufficient qualification in the applicable subject area.
2.6 Insurance
No insurance cover is provided with any purchase from us. No responsibility is accepted by us for insurance cover. It is your responsibility to ensure you hold sufficient insurance cover.
3.0 Online Learning Platform (OLP)
3.1 Academy Sign Up
Academies are invited to join our online learning platform (OLP) for the advertised fee (see membership types below). Our OLP is a paid membership only platform hosting service and is provided either as a pay as go or subscription service for your academy. By joining our OLP, you are agreeing to the below Membership terms. You will have access to advertise and enrol students onto the courses we have listed for either in house or fully online learning on our website.
Student enrolment must be purchased via our website. We will endeavour to complete enrolment within 48 hours of purchase. Once enrolled each student is granted 6 months access to our OLP for their course. When the enrolment period has expired, students can choose to extend their enrolment for an optional fee set by you and payable directly to you. You will then pay us a fixed fee to extend their access for a further 6 months. Extensions can only be purchased once. Students must use their own e-mail address and cannot share log in details. Once students have accessed the OLP (i.e. progress is >0%) all purchases are final.
Upon the first purchase of a new OLP course for your student, you, the purchaser will be signed up to view the course content prior to your student being enrolled. It is your responsibility to ensure all information is correct and give consent for students to be enrolled. You will be issued with a skeleton scheme of work for the OLP content to combine with an in-house scheme of work for accreditation purposes.
Learning Resource Hub accepts no responsibility for unspent codes/credits and is not responsible for the student’s completion of online OLP material.
Scheduled updates of student’s progress will be issued periodically to you, it is your sole responsibility to ensure students complete their OLP material prior to certification being issued.
Any students or academies found to be sharing log in details/course content will be immediately suspended pending further investigation. Anyone found to be in breach of this will not be entitled to any refund or reactivation of their account.
The Learning Resource Hub and any content accessed through the platform are for your student’s sole use and may not be shared outside of the platform. During your use of the Learning Resource Hub platform, we grant you a limited, non-exclusive, non-transferable right to access the platform and Learning Resource Hub content. Except for the foregoing, no right, title, or interest shall be transferred to you.
3.1 Intellectual Property
At all times, even following purchase of student enrolment, the intellectual property rights and copyright connected with those materials remain ours. You have the right to enrol and withdraw students from the OLP platform via us. You are not permitted to imitate, loan log in details or provide copies to third parties whether for free or as part of a sale. All material is copyright to Learning Resource Hub.
3.2 Feedback and Complaints
If you have any feedback about our OLP platform, please do share it with us. It is always great to receive words of praise and helpful to get constructive comments. We really hope that you love our OLP platform, but if you would like to make a complaint this should be made to made in writing to contact@learningresourcehub.co.uk.
3.3 Updates, Changes and Content
Our OLP content is subject to removal from sale, updates, and modifications at any time. No responsibility is accepted by us for changes made to our material in relation to your purchase. Once Student enrolment is validated this material will not change for the duration of their sign up.
We endeavour to ensure the information provided to you in our OLP platform is correct, however it is your responsibility to check the content in relation to your teaching practice and use the OLP platform responsibly.
3.4 Accreditation
Our OLP platform is designed to be used in conjunction with either in-house/face to face training arranged and taught by you or fully online training that is marked and signed off by you. We accept no responsibility in the guarantee that accreditation will be achieved. It is your responsibility to ensure you have the correct, and sufficient material to meet the criteria of your chosen accreditor. If you are unsure, please check with your chosen accreditor prior to purchase. Please be aware where you choose to use an accreditor who is not on our approved partner list, it is your responsibility to purchase any additional material you may need to gain accreditation, including but not limited to training manuals and schemes of work.
3.5 Qualification
Purchasing student enrolment does not constitute a qualification in the purchased subject area. No responsibility is taken by us for training or treatments carried out without the relevant qualifications in place. All liability resides with you as the student’s training academy.
It is your responsibility to ensure you hold sufficient qualification in the applicable subject area before undertaking teaching activities.
3.6 Insurance
No insurance cover is provided with any purchase from us. No responsibility is accepted by us for insurance cover. It is your responsibility to ensure you hold sufficient insurance cover.
4.0 Membership Types
Learning Resource Hub provides different membership options that allows our members to enrol students onto our OLP throughout the duration of their membership (see inactivity below).
These Terms of Use govern your use of our service. As used in these Terms of Use, "OLP", "our platform" or "the platform" means the education hosting platform provided by Learning Resource Hub for the delivery of online learning content to students of your academy. References to ‘you’ in these Terms of Use indicate the member who created the account and whose payment method is charged.
Pay as you Grow Membership
4.1 Pay as your grow is our default membership option. By paying the joining fee to use our OLP, you are granted access to the library of courses we offer and can enrol students for the advertised fee.
4.2 Inactivity: On payment of the joining fee, you have 6 months access to the platform, if you do not enrol any students within a 6-month period your membership will be terminated, and the joining fee will be applicable to reinstate your membership. Activity is monitored on a rolling 6-month basis.
Monthly Subscription Membership
4.3 Your Learning Resource Hub membership will continue until terminated. To use the Learning Resource Hub “OLP” you must have Internet access and provide us with one or more Payment Methods. "Payment Method" means a current, valid, accepted method of payment, as may be updated from time to time. Unless you cancel your membership before your billing date, you authorise us to charge the subscription fee for the next billing cycle to your Payment Method (see "Cancellation" below).
4.4 We may offer several subscription plans. These subscription plans may change from time to time. We will notify you at least one month before any changes to your subscription plan will become effective. If you do not wish to accept the change to your subscription plan, you can cancel your membership before the change takes effect.
4.5 Billing Cycle. The subscription fee for the Learning Resource Hub platform will be charged to your Payment Method on the specific payment date indicated on the "Account" page. The length of your billing cycle will depend on the type of subscription plan that you choose when you signed up for the platform. In some cases your payment date may change, for example if your Payment Method has not successfully settled, when you change your subscription plan or if your paid subscription began on a day not contained in a given month
4.6 Payment Methods. To use the Learning Resource Hub platform, you must provide one or more Payment Methods. You authorise us to charge any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method.
4.7 Updating your Payment Methods. You can update your Payment Methods by going to the "Account" page. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorize us to continue to charge the applicable Payment Method(s).
4.8 Cancellation. You can cancel your Learning Resource Hub membership at any time, and you will continue to have access to the Learning Resource Hub service through the end of your billing period. Payments are non-refundable and we do not provide refunds or credits for any partial membership periods or unused Learning Resource Hub content. To cancel, go to the "Account" page and follow the instructions for cancellation. If you cancel your membership, your account will automatically revert to a pay as you go account.
4.9 Changes to the Price and Subscription Plans. We may change our subscription plans and the price of our service from time to time. We will notify you at least one month before any price changes or changes to your subscription plan will become effective. If you do not wish to accept the price change or change to your subscription plan, you can cancel your membership before the change takes effect.
